first_imgElectric eels are inspiring a new generation of fuel cells.  Science Daily reported that a remarkable fusion of engineering and biology may lead to tiny electronic devices that run on biology’s own energy currency, ATP.  “Engineers long have known that great ideas can be lifted from Mother Nature, but a new paper by researchers at Yale University and the National Institute of Standards and Technology (NIST) takes it to a cellular level.”    The voltage-generating cells in an electric eel are called electrocytes.  They work by pumping sodium and potassium ions in and out of the cell membrane through specially designed channels or gates (see 01/17/2002).  The cells are then stacked in series, to build up voltage, and in parallel, to build up current.  The result?  An electric eel can generate 600 volts – enough to knock a horse off its feet (see National Geographic).  Electric eels and other forms of electric fish use their powers primarily at lower levels for navigation (05/05/2004), communication, and even courtship (see 06/20/2007, bullet 5).    The Yale-NIST team is using a “systems biology” approach (08/21/2003), considering the overall context of function, to understand and build on biological technology.  Of seven types of channels in the cell membrane, the specifications of each are being examined: reaction time, density in the membrane, and more.  “Nerve cells, which move information rather than energy, can fire rapidly but with relatively little power,” the article said, whereas “Electrocytes have a slower cycle, but deliver more power for longer periods.”  Tweaking the specs in engineering models allow bio-engineers to optimize voltage production for human applications.    The article not only ignored evolution completely, it seemed positively fixated on design.  “Applying modern engineering design tools to one of the basic units of life, they argue that artificial cells could be built that not only replicate the electrical behavior of electric eel cells but in fact improve on them,” the body of the story began.  David LaVan, NIST engineer, put it this way: “Do we understand how a cell produces electricity well enough to design one—and to optimize that design?”  This is reverse engineering – which implies intelligent design.  An engineer has to see and appreciate design to want to emulate it.    In this case, engineers don’t have to copy the design with their own components made from scratch, as with gecko-foot tape (see 12/06/2006, 06/20/2007.)  They can take parts from existing off-the-shelf technology and adapt it for human-designed applications.  They can use engineered proteins to build membranes.  They can tailor bacteria or mitochondria (cellular powerhouses) to produce ATP for energizing the reactions.  They can modify electrocytes to produce continuous electrical current instead of pulses.    An interesting question comes to mind.  If an extraterrestrial engineer were to land in the lab and study the eel and the biological electronics designed by humans, would it know where the evolution stops and the intelligent design begins?Answer: yes, it would know that evolution stopped at the science door and intelligent design produced the whole show.  Evolution as a concept would be the trash can for explaining mistakes and degeneration.    “Nerve cells … move information rather than energy.”  Did you catch that?  Your body is wired for the intranet as well as for power.  Let CEH help empower you to get good information flowing.(Visited 11 times, 1 visits today)FacebookTwitterPinterestSave分享0last_img read more

first_imgThe Internet of Things (IoT) is growing at an unprecedented rate and can help businesses deliver new opportunities and be successful in the long run. The promise of a vibrant future that IoT holds can be deciphered from the following facts:7 billion active IoT devices on a global level (IoT Analytics report)The number of IoT devices that are active is expected to grow to 10 billion by 2020 and 22 billion by 2025. (IoT Analytics report)By the end of 2021, the internet of things and is expected to be worth 520 billion U.S. dollars. (Statista)Certain innovative IoT trends are already giving businesses the opportunity to digitally innovate itself. The Internet of Things has a lot to offer to help businesses gain the edge over competitors. If you’re a business wanting to leverage IoT to the core, you must know about everything that a Modern IoT platform should have in 2019.Artificial Intelligence should be incorporated within IoT.As mentioned above, the Internet of Things has grown enormously over the past few years. There are over 17 billion connected devices worldwide. The majority of them work on a single small processor along with a tiny portion of memory. In short, IoT has already become omnipresent. The Internet of Things can be further empowered by incorporating advanced artificial intelligence into it.This, in turn, would facilitate IoT to build excellent opportunities for data analysis and interpretation. For instance, with artificial intelligence (AI) incorporated IoT, a self-driving car would not only safely drop a person, but also leverage the transit data to give accurate traffic pattern prediction. As a result, it would help in the construction of more efficient infrastructure and roads in the future.A manufacturing example would be that of a factory that makes use of IoT-connected assembly lines. It would assist them in reducing the rate of manufacturing errors in the fabrication process. All in all, putting artificial intelligence and machine learning into IoT devices has enormous potential benefits. Big brand names such as Amazon, Google, Microsoft, IBM, etc. are already making extensive use of AI in their IoT devices and extracting the best out of it.The implementation of AI in the IoT space with self-driving cars has made heads turn.Tesla, for example, has introduced machine learning-based self-driving cars with limited autopilot capabilities. What works here is skilled programming that enables the makings of a self-driving car, which understands the rules of the road and manages all obstacles efficiently. However, there are certain shortcomings. The most significant issue being the inability of programmers to program for every possible variable that happens when other drivers are presented into the mix. A Tesla car gathers real-time data from other Tesla cars present on the road, thus making the presence of any new variable seamlessly easy to learn and share with other connected vehicles – helping secure autopilot mode for Tesla drivers. There should be a rise in industrial IoT & digital twin technology.Industrial IoT enhances the efficiency and productivity of business through extensive data analysis and integration. In fact, including industrial IoT within the IoT framework add to its growth at an exponential rate. Moreover, the manufacturing industry can also leverage the most out of it. It doesn’t only make the manufacturing sector effective but also reduces its risk factors while enhancing its profitability.Another critical aspect that a modern IoT platform must have is the use of digital twin technology.  According to a survey by Gartner, within 3-5 years, billions of things will see its representation through digital twins.Digital twins is a powerful software that works as a virtual model for a particular product, process or service.Incorporating it with IoT will reduce the gap between the physical and virtual world.Further, it would allow a thorough analysis of data while monitoring the systems. Monitoring, in turn, would subside the problem even before its occurrence. Monitoring controls would also prevent downtime, provide new opportunities and facilitate future planning through simulation. These three benefits of preventing downtime, providing new opportunities, and driving future planning with simulation make this VR world highly imperative for businesses to adopt the amalgamation of digital twins and IoT. Moreover, being amidst Gartner’s Top 10 Strategic Technology Trends, digital twins technology is here to stay. Hence, businesses who do not incorporate this strategy will lose out to competition big time.Incorporation of General Data Protection Regulation (GDPR)IoT devices collect a lot of data. So, it becomes critical to incorporate IoT related security standards. It can be done by implying the General Data Protection Regulation into it. GDPR works as a regulation for the handling of personal and sensitive data. Therefore, businesses which want to run successfully should keep this aspect in mind when using any IoT technology. To put it in other words, a transparent and clear disclosure regarding the collected data can do the needful. The IoT developers should take care of a standard level of compliance and security at various levels. These levels include data encryption, different means of verification, active consent, etc. In short, the main aim of the IoT devices or any software used by businesses should be a legitimate collection of data. It should be done in a way that makes its accessibility, processing as well as storage to a minimum.Remember, if the intention behind the collection of customer data and the way it is collected is made clear — it will boost the confidence of customers in your business and give you an edge over competitors. The use of cloud IoT solutionsThe popularity of cloud solutions for IoT is on an all-time high.Amazon’s AWS and Microsoft’s Azure cloud services were found to be the top choices for cloud development of IoT products at the 2018 IoT Developer survey. These two giants have the marketing capabilities, infrastructure, and accessibility needed for the immediate release of any new IoT device.Microsoft’s Azure IoT central platform which was released in 2018, facilitates safer communication amidst devices and the cloud. It basically works as a software plug and play solution which connects IoT firmware to the cloud. Therefore, including Cloud Solutions within your IoT device can work wonders for your business, and investing in it can help a company extract its potential to the fullest.Achieving momentum with edge computing.Edge computing works as a distributed and open IT infrastructure. It processes the data near the edge of the network where the data generation is taking place. It doesn’t rely on a centralized data-processing warehouse. Instead, it focuses on decentralized processing power and enables mobile computing and the Internet of Things technologies. The edge computing facilitates the processing of data by the device itself. It doesn’t work on the data transmitted through a data center, making it critical for the proper functioning of IoT devices. You should remember that cloud computing isn’t always an option. There are situations where constant connectivity isn’t possible. When a continuous connectivity isn’t possible — then edge computing can come in handy. Because, it has the potential to process, analyze and execute data even when away from full network coverage.Microsoft, Google, Amazon, etc. are making significant use of edge computing. It doesn’t only work as a great computing substitute for cloud technology but can also bring it anywhere securely and safely. Therefore, if you wish to achieve momentum through your IoT strategy, incorporating edge computing can do wonders for your business in 2019.The same tech is used with Amazon’s AWS IoT Green grass service. It makes use of edge devices and gives developers the power of using Lambda functions. The Lambda function, in turn, allows developers to make use of machine learning while calculating tasks within IoT devices. So, it is quite clear that edge computing has a lot to offer to IoT devices and should undoubtedly be an integral part of any modern IoT platform.Including 5G standards.Source: FreepikIncorporating 5G standards within IoT devices increases its potential to a significant level.Besides reducing the latency, it enhances the reliability of mobile communication with embedded devices. With reduced latency, the connected IoT devices will facilitate sending and receiving the data in a faster way. It would further allow seamless analysis and management of data.An application or service that requires rapid and instant computing within a brief period can extract huge benefits from this impeccable technology.Look at the strides being made in the transportation sector to logistics and infrastructure, and every industry can leverage 5G standards and pave new avenues of success. Therefore, if you possess a concrete business plan at hand, you should consider deploying this high-end technology within your modern IoT platform.Using LPWAN for IoT sensorLPWAN or Low-Power Wide-Area Network can increase the potential of IoT enabled devices. The LPWAN works with ease for any small device that requires high operating lifespan situated in remote locations. Tiny sensors that have the ability to function with a low transmission rate of LPWAN can successfully integrate itself with LPWAN connectivity. With devices connected through LPWAN predicted to reach more than a billion in 2023, the importance of incorporating IoT into your business becomes all the more imperative.Making use of Voice-enabled Internet of ThingsSource: FreepikVoice-enabled assistants have shown tremendous growth in recent years.Apart from the smart home automation market, it is also expanding its wings in the industrial sector. It does not only utilize the hands-free control and rapidly tracks the processes but, likewise, lowers the costs of maintenance and management. The careful management, in turn, provides businesses with an opportunity to include easy-to-use communication method between end users and their respective devices.Take a look at the growth in the voice assisted devices. Where are these devices doing the most good for businesses? With the use of voice assistants predicted to grow 1000%, reaching a whopping 275 million devices by 2023, it surely is a dominating factor in shaping the way a business operates and functions. From Alexa to Google Home, these voice-enabled IoT products are working as a driving force and helping businesses be successful – one IoT strategy at a time.Involving innovation to complex IoT solutionsIncorporating IoT with other tech innovations can facilitate the working of various technologies together. As a result, it can help businesses achieve specific goals seamlessly. Take a look at a few innovative technologies that are helping IoT become more high-end and top notch.1. BlockchainBlockchain facilitates the protection of data from potentially unsafe devices. It works as a digital ledger for saved information and distributes the data throughout the plethora of devices connected with the chain. As a result, it makes it impossible to make any accidental or malicious changes to the data.Incorporating Blockchain within IoT devices will thereby, make any business more reliable and secure.Blockchain is the reason many of the IoT devices are already including Blockchain within it. In fact, 20% of IoT devices are having some sort of Blockchain service incorporated into its data collection method. So, it wouldn’t be wrong to say that Blockchain has found its widespread use in IoT devices.2. WebRTCKnown as Web Real-Time Communication, WebRTC is an open source project that facilitates the deployment of two-sided communications between IoT products. It does so through a simple browser without any requirement of specific tools or plugins. WebRTC has brought a lot of features and functions on board with lesser development time, efforts as well as auxiliary tools. Here’s an example of Amazon’s newly developed Sensor and Alexa APIs that will help make this concept clearer. It not only allows seamless communication with the end user but, also helps the users connect cameras, doorbells, and Alexa-enabled Echo devices. In conclusion, incorporating technologies like these are making IoT devices easy to function without any extensive effort.5 Industry Problems that the Internet of Things can Help Solve in 2019Just like the internet has revolutionized the way we think, feel, behave, live and work, the Internet of Things and its concept of a ‘connected world’ has made the world a much smaller, safer and smarter place. Not only that, IoT promises to deliver a much viable solution for industry problems such as Healthcare, Agriculture, Energy Conservation, Road Traffic Management, and Security Management, to name a few.1. Healthcare CrisesIoT is helping cater to medical emergencies like never before.Like never before we can now facilitate the monitoring of patient’s health status by healthcare professionals.  Assistance to cardiac emergencies through a connected medical facility has already been implemented. In an IoT enabled system, any health crisis of a patient connected to the heart monitor can automatically trigger an alarm at the nurse station, saving precious lives.2. Agricultural IssuesAlthough agricultural harvests rely heavily on natural elements and conditions, IoT can help predict these occurrences for farmers and agricultural workers, to plan and take action accordingly. Moreover, IoT-powered temperature sensor can be harnessed by agriculturists to turn on sprinklers, when the temperature reading crosses the specified limit.3. Energy ConservationWith the increasing depletion of natural resources, energy conservation with the help of the Internet of Things has created options for smart home automation. Having these functions have empowered homeowners to not only conserve energy but also monitor their daily, weekly, and monthly usage.4. Road Traffic ManagementWith cities across the world dealing with traffic congestion at peak hours, IoT can be a great enabler. Traffic regulators, ambulances, etc. can take the help of connected devices linked to IoT sim cards such as GPS devices, smartphones, cameras, traffic lights, and cars to help monitor traffic patterns and keep drivers informed of traffic situations.5. Security ManagementBusinesses have been increasingly relying on connected systems like the Internet of Things for managing the security of their workplace premises and buildings. One of the most favored being IoT sim cards that can be connected to sensors such as footprint sensors, biometric sensors, facial recognition, etc.How to Choose the Right IoT Development CompanyIt is recommended that you choose an experienced mobile app development company.Merely saying that you need an experienced mobile app development company doesn’t say it all. You have to have a companyt that has a proven expertise with IoT development and open source IoT frameworks. IoT solution mostly comprises of web software. first_imgSerena and Venus Williams will both be heading home early after losing to little-known opponents at the French OpenInstead of playing each other this week at the French Open, Serena and Venus Williams will both be heading home early. The American sisters both lost in the second round on Wednesday, each being outplayed by little-known opponents at Roland Garros.Serena, the defending French Open champion and a 17-time major winner, lost to Garbine Muguruza of Spain 6-2, 6-2. It is her earliest exit at a major tournament since falling in the first round at Roland Garros two years ago – and her most-lopsided loss ever at a Grand Slam.A short time earlier, older sister Venus was eliminated by Anna Schmiedlova of Slovakia 2-6, 6-3, 6-4.The Williams siblings would have met in the third round had they both won.”It was one of those days. You can’t be on every day, and, gosh, I hate to be off during a Grand Slam,” the top-seeded Serena said. “It happens, you know. It’s not the end of the world. It is what it is.”The sisters have lost on the same day at a major tournament twice before, with the last coming in the fourth round at Wimbledon in 2011. The other time was at the French Open in 2008 in the third round. With Li Na also eliminated, it is the first time in the Open era that the top two seeded women have lost before the third round at any Grand Slam tournament.advertisementSerena struggled from the start against the 20-year-old Muguruza and finished the match with only eight winners and 29 unforced errors.”Just nothing really worked,” Serena said. “I don’t know anything that actually worked.”Muguruza was playing at the French Open for only the second time in her career. She lost in the second round last year, but reached the fourth round at the Australian Open in January.Venus’ loss was the eighth time in her last nine major tournaments that she has failed to win more than one match. The seven-time Grand Slam champion won the first set and was up an early break in the second. But the 19-year-old Schmiedlova responded by taking eight of nine games and won 2-6, 6-3, 6-4.”I felt like this was a match that I was most likely going to win. I’m sure, I don’t know how Serena felt, but I’m sure she feels like that every time she goes on the court,” Venus said. “So I think our expectation was to play in the next round.”Since reaching the fourth round at Wimbledon in 2011, Venus has been eliminated in the first or second round at every Grand Slam tournament she has played except the 2013 Australian Open, where she reached the third round. At 33 years old, Venus is far from her best. But she has been having a solid season in 2014, winning a hard-court title in Dubai and reaching the final in Auckland.Against Schmiedlova, the 29th-seeded Venus ended up with 47 unforced errors. Schmiedlova had only 20.Venus won the last of her seven major titles at Wimbledon in 2008. She has never won the French Open, but lost to Serena in the 2002 final in their only meeting at Roland Garros.No. 12 Flavia Pennetta of Italy also lost, while No. 8 Angelique Kerber of Germany and No. 18 Eugenie Bouchard of Canada won. Also Wednesday, 2012 French Open champion Maria Sharapova was scheduled to play.In the men’s tournament, both Roger Federer and Novak Djokovic made it through to the third round.Federer beat Argentine qualifier Diego Sebastian Schwartzman 6-3, 6-4, 6-4 Wednesday, while the second-seeded Djokovic defeated Jeremy Chardy of France 6-1, 6-4, 6-2.Djokovic needs to win the French Open to complete a career Grand Slam.No. 8 Milos Raonic of Canada, No. 6 Tomas Berdych of the Czech Republic, No. 18 Ernets Gulbis of Latvia, No. 25 Marin Cilic of Croatia, No. 27 Roberto Bautista Agut of Spain, No. 29 Gilles Simon of France and No. 31 Dmitry Tursunov of Russia also advanced to the third round.No. 15 Mikhail Youzhny of Russia and No. 20 Alexandr Dolgopolov of Ukraine lost. One match that carried over from the first round ended quickly Wednesday with Steve Johnson of the United States advancing. The American saved two match points on Tuesday in the third set before completing a 4-6, 6-7 (7), 7-6 (3), 6-3, 6-3 win over Laurent Lokoli of France. The match had been suspended because of darkness on Tuesday night with Johnson leading 3-1 in the fifth.last_img read more

first_imgOur study demonstrates the possibility of using eye-transplanted islets of Langerhans as a tool for improving the development of new drugs and, in combination with the local administration of immunosuppressive drugs, as a new clinical transplantation strategy for patients with type 1 diabetes,”Per-Olof Berggren, study leader, Professor at the Department of Molecular Medicine and Surgery Source:Karolinska InstitutetJournal reference:Berggren, P. et al. (2019) In vivo imaging of type 1 diabetes immunopathology using eye-transplanted islets in NOD mice. Diabetologia. Reviewed by James Ives, M.Psych. (Editor)May 15 2019By the time type 1 diabetes is diagnosed, most of the insulin-producing beta cells have already been destroyed. Now, using an innovative transplantation technique, researchers at Karolinska Institutet and University of Miami Miller School of Medicine have been able to intervene to save the beta cells in mice by discovering early signs of the disease. The study is published in Diabetologia, the scientific journal of the European Association for the Study of Diabetes (EASD).Type 1 diabetes is caused when the insulin-producing beta cells in the endocrinal part of the pancreas – the islets of Langerhans – are destroyed by an autoimmune attack. There are currently no drugs to prevent the disease developing.Understanding the mechanisms that give rise to type 1 diabetes is essential to the development of drugs able to prevent damage to the beta cells. One major hurdle is that the disease is often discovered too late, when the beta cells are already destroyed. Scientists therefore need to find a robust diagnostic method that involves identifying early autoimmune markers.Transplanted to the eyeThe present study shows that the islets of Langerhans transplanted to the anterior chamber of the eye can be important reporters of autoimmunity and the development of type 1 diabetes. By studying transplanted islets of Langerhans in a mouse model with type 1 diabetes, the researchers found that the islets showed signs of inflammation long before other indicators of the disease appeared.”This information is important as it means that treatment can be given before the insulin-producing cells have been destroyed in the autoimmune attack, which is imperative if patients are to retain their ability to secrete insulin,” says study leader Per-Olof Berggren, Professor at the Department of Molecular Medicine and Surgery and the Rolf Luft Research Center for Diabetes and Endocrinology at Karolinska Institutet in Sweden and Visiting Professor at the Diabetes Research Institute, University of Miami Miller School of Medicine (USA), who developed the transplantation technique.Managed to retard the attackRelated StoriesDiet and physical exercise do not reduce risk of gestational diabetesMetformin use linked to lower risk of dementia in African Americans with type 2 diabetesNew biomaterial could encapsulate and protect implanted insulin-producing cellsOn monitoring the graft in real time before and after the development of type 1 diabetes, Professor Berggren and his colleague Dr Midhat Abdulreda at the Diabetes Research Institute, University of Miami Miller School of Medicine, found that the transplanted islets were attacked by the immune system in a way similar to those in the liver during type 1 diabetes. The infiltration of immune cells took place concurrently with the signs of autoimmunity, namely inflammation in the islets and later hyperglycemia. Guided by these early symptoms of an autoimmune reaction, the researchers were able to retard the attack on the islets with both systemic and local immunosuppression.New transplantation strategylast_img read more

In this Dec. 8, 2017, file photo, coins are displayed next to a Bitcoin ATM in Hong Kong. The IRS says that cryptocurrency transactions are taxable by law. That means people who made money (or lost it) on Bitcoin trades, “mined” Ethereum or even bought a cup of coffee with digital currency face potential tax implications. Failure to report it could mean potential audits, fines and penalties. (AP Photo/Kin Cheung, File) Cryptocurrencies like bitcoin may not be regulated by the government, but they’re still subject to being taxed. WOULD THEY IRS REALLY KNOW?True, the IRS only knows what you tell them, to a degree. However, if they find out that you were not properly reporting the income from virtual currency transactions, you could be held liable. And experts are quick to point out that the IRS is very interested in this new frontier. In 2016, a court authorized the IRS to summon information on Americans who engaged in business with Coinbase, a virtual currency exchange, to look for tax wrongdoing. It later narrowed its search to high-level traders, but was clear in its message that it will make sure all taxpayers are paying their share.Omri Marian, a law professor at University of California, Irvine, called cryptocurrencies potential “super tax havens” back in 2013. He says people may still be using them to evade taxes but he is more optimistic these days, in part, because the IRS is going after this matter.”This reminds me a lot of the Swiss bank crisis awhile back,” said Cross. “People were confident (their information) wouldn’t be revealed to the IRS and it worked for (years) but when Switzerland cracked, it was too late. People faced penalties and went to jail.”SO WHAT DO I DO?Keep good records. It’s tough to figure out the value of some of these transactions. There is software out there to help you figure out your capital gains and losses for digital currencies, such as and You can also seek out a tax professional or other expert who has some experience in this field. And “be deliberate about when to make crypto trades” says Cross. It’s very easy to get caught up in the next trade without realizing how it’s calculated. You could be racking up considerable capital gains without realizing it. Another key thing to remember is that these digital currencies are taxed as property, instead of currency, for tax reasons. That means the same rules apply if you sell bitcoin as if you sold stocks. © 2018 The Associated Press. All rights reserved. Part of their appeal is that it could be used as a new, more anonymous kind of currency that operates outside the traditional banking system and government oversight.”There’s a very strong sentiment that taxing cryptocurrency is sort of sacrilegious,” said Tyson Cross, a tax attorney in Reno, Nevada who specializes in this niche. “But most people understand there is a difference between upholding a principle on an anonymous internet forum and going to jail over it.”The IRS didn’t weigh in on how to tax digital currency until 2014 and that remains its only guidance to date. We spoke to a few experts to help break down the basics:WAIT, I OWE TAXES ON THIS?Yes, most likely. All digital currency transactions are taxable events, according to the IRS. That includes if you sell it, trade it, “mine” it, use it to pay for something or were paid with it. Even if you sell cryptocurrency and keep the gains in your exchange account, instead of as real cash in checking account, it’s still taxable.Bought some bitcoin but still holding on to it? Relax, you don’t owe any taxes yet. But any time the digital currency’s value was “realized,” you need to report it.How it is taxed depends on how you used it, said Lisa Greene Lewis, a CPA and tax expert at TurboTax. Apple-Samsung iPhone design copying case goes to jury Apple argued in court that the iPhone was a “bet-the-company” project at Apple and that design is as much the “article of manufacture” as the device itself. A federal court jury on Thursday ordered Samsung to pay Apple $533 million for copying iPhone design features in a patent case dating back seven years. The three design patents in the case apply to the shape of the iPhone’s black screen with rounded edges and a bezel, and the rows of colorful icons displayed.Samsung no longer sells the smartphone models at issue in the case. Two utility patents also involved apply to “bounce-back” and “tap-to-zoom” functions. An original trial finding that Samsung violated Apple patents preceded a lengthy appellate dueling over whether design features such as rounded edges are worth all the money made from a phone.Technology vs StyleSamsung challenged the legal precedent that requires the forfeiture of all profits from a product, even if only a single design patent has been infringed. The US Supreme Court in 2016 overturned the penalty imposed on the South Korean consumer electronics giant.Justices ruled that Samsung should not be required to forfeit the entire profits from its smartphones for infringement on design components, sending the case back to a lower court.”Today’s decision flies in the face of a unanimous Supreme Court ruling in favor of Samsung on the scope of design patent damages,” the South Korean company said in response to an AFP inquiry.”We will consider all options to obtain an outcome that does not hinder creativity and fair competition for all companies and consumers.”Apple did not respond to a request for comment. The key question of the value of design patents rallied Samsung supporters in the tech sector, and Apple backers in the creative and design communities.Samsung won the backing of major Silicon Valley and other IT sector giants, including Google, Facebook, Dell and Hewlett-Packard, claiming a strict ruling on design infringement could lead to a surge in litigation.Apple was supported by big names in fashion and manufacturing. Design professionals, researchers and academics, citing precedents like Coca-Cola’s iconic soda bottle. The case is one element of a $548 million penalty—knocked down from an original $1 billion jury award —Samsung was ordered to pay for copying iPhone patents. Jurors tacked on an additional $5 million in damages for a pair of patented functions. The award appeared to be a bit of a victory for Apple, which had argued in court that design was essential to the iPhone. The case was keenly watched as a precedent for whether design is so important that it could actually be considered the “article of design” even in a product as complex as a smartphone.”We don’t think it is supported by the evidence,” Samsung attorney John Quinn told US District Court Judge Lucy Koh after the verdict was read in her courtroom in Silicon Valley.”We have every concern about the determinations about the article of manufacture.”Quinn declined an offer by the judge to send jurors back for further deliberation, saying Samsung would pursue post-trial motions to address its concerns about the verdict.Juror Christine Calderon said the panel agreed that one of the design patents—the grid of colored icons—did represent the whole phone, while the other two at issue in the trial were seen as the display assembly that gave the iPhone its look. She compared it to the Mona Lisa: “you use the paint, but it is not the article of manufacture.””I had to really think about it,” the 26-year-old Calderon, a technical writer, said after Koh dismissed the jury.”We kind of felt like we ended up at a happy medium.”Long legal roadThe case had been sent back to the district court following a Supreme Court decision to revisit an earlier $400 million damage award. Apple reasoned in court that design was so integral to the iPhone that it was the “article of manufacture” and worth all the money Samsung made by copying the features. The lower figure sought by the South Korean consumer electronics titan would have involved treating the design features as components. The jury had been asked to determine whether design features at issue in the case are worth all profit made from Samsung smartphones that copied them—or whether those features are worth just a fraction because they are components.
